Terms of Service

These Terms of Service ("Terms") govern your access to and use of Firefly ("the Bot", "we", "us", or "our"), including any premium features, website, and related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By inviting Firefly to your Discord server or using any of its features, you agree to these Terms. If you do not agree to these Terms, do not use the Service.

You must also comply with Discord's Terms of Service and Community Guidelines.

2. Description of Service

Firefly is a Discord bot that provides various features including but not limited to:

• Server moderation tools
• Leveling and XP systems
• Music playback
• Economy systems
• AI chat features
• Utility commands

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. User Accounts and Access

To use the Service, you must have a valid Discord account. You are responsible for:

• Maintaining the security of your Discord account
• All activities that occur under your account
• Ensuring that your use complies with these Terms

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Violate Discord's Terms of Service or Community Guidelines
• Harass, abuse, or harm other users
• Distribute spam, malware, or malicious content
• Attempt to exploit, hack, or reverse-engineer the Service
• Use automated tools to abuse the Service (self-bots, macros for XP farming, etc.)
• Circumvent rate limits or usage restrictions
• Impersonate Firefly staff or misrepresent affiliation with us
• Use the Service for illegal activities
• Distribute copyrighted content without authorization

5. Premium Subscriptions

Billing:

• Premium subscriptions are billed monthly or yearly as selected
• Payments are processed securely through Stripe
• Prices are listed in USD and may vary by region
• Subscriptions auto-renew unless cancelled before the renewal date

Upgrades and Downgrades:

• You may upgrade or downgrade your subscription at any time
• When upgrading, you will be charged the prorated difference for the remainder of your billing cycle
• When downgrading, the new price takes effect at your next billing cycle

Cancellation:

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No partial refunds are provided for unused time after cancellation

Refunds:

• We offer a 7-day money-back guarantee for first-time purchases
• Refund requests must be made within 7 days of your first payment
• Subsequent purchases are non-refundable except as required by law
• Refunds are processed to the original payment method

Gifting:

• Premium can be gifted to any server
• Gifts are non-refundable once redeemed
• Unredeemed gifts may be refunded within 30 days

6. BYOK (Bring Your Own Key) Features

For certain AI features, you may provide your own API keys:

• You are responsible for any costs incurred through your API keys
• We encrypt and store your keys securely but cannot guarantee absolute security
• You must comply with the terms of service of the API provider (e.g., Google)
• We are not liable for any issues arising from your use of third-party APIs
• You may revoke or change your API keys at any time

7. Music Features

The music feature streams content from various sources:

• We do not store or host any music files
• You are responsible for ensuring you have the right to play content in your server
• Music playback is for personal, non-commercial use only
• We may disable access to certain content or sources at any time

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Firefly and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the Service
• Use our trademarks or branding without permission
• Create derivative works based on the Service

9. User-Generated Content

You retain ownership of content you create using the Service (custom messages, configurations, etc.). By using the Service, you grant us a limited license to store and process this content as necessary to provide the Service.

You are solely responsible for any content you create or share through the Service.

10. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for:

• Violation of these Terms
• Abuse of the Service
• Requests from law enforcement
• Any other reason at our sole discretion

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data (except as required by law)
• Premium subscriptions are non-refundable upon termination for violation

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• The Service will meet your requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIREFLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption
• Computer damage or system failure
• The cost of substitute services

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Firefly, its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending a notification through Discord for material changes

Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
